These Terms of Service govern use of the Paleta Studio store and purchases made through paletastudio.shop. The store is operated by ERUDITEJASMINE UNIPESSOAL LDA, VAT PT518021475. Contact: info@paletastudio.shop.
By using the store or completing an order, you agree to these terms to the extent permitted by applicable law. Nothing in these terms limits mandatory consumer rights.
1. Products and information
We aim to present descriptions, images, prices and availability clearly and accurately. On-screen color appearance can vary depending on device, calibration, lighting, skin tone, application and blending. Shade codes and images should therefore be used as a selection reference.
Products identified as Kryolan are genuine products of that brand. Paleta Studio is an independent retailer and is not the manufacturer and does not represent itself as an official Kryolan representative unless expressly stated otherwise.
2. Custom palettes
For custom Dermacolor palettes, the customer chooses a 6- or 12-shade format, the shades and the position of each refill using the configurator. Before proceeding to the cart, the customer must review the complete composition.
The palette is assembled according to the composition confirmed and recorded with the order. Repeated shades are permitted when selected by the customer. Changes after the order is completed are possible only if preparation has not yet started and Paleta Studio expressly confirms the change.
Because these palettes are assembled according to the consumer’s individual specifications, they may fall within the statutory exception to the right of withdrawal, as explained in Returns & Refunds. This does not affect rights relating to assembly errors, defects or lack of conformity.
3. Prices, taxes and payment
Prices are shown in the currency indicated on the storefront or at checkout. The international store’s commercial base currency is EUR. Taxes, shipping costs and other charges are displayed according to the applicable checkout configuration.
Payment is processed through the payment methods made available by Shopify and/or the relevant payment providers. Paleta Studio will not ask customers to send complete card details by email or through the contact form.
4. Order formation and acceptance
Submission of an order is subject to availability, payment validation, applicable anti-fraud checks and our ability to fulfil the order. If we cannot accept or fulfil an order, we will contact the customer and take the steps required by law, including a refund where applicable.
We may refuse or cancel orders in cases of manifest pricing error, reasonable suspicion of fraud, inability to supply or another legitimate reason, without prejudice to mandatory consumer rights.
5. Preparation, shipping and delivery
Normal preparation time is 3 to 7 business days, particularly for custom palettes. Shipping methods, costs and estimates are displayed at checkout and are subject to our Shipping Policy.
The customer is responsible for providing a complete and accurate delivery address. Transport risk transfers according to applicable law and is not accelerated by these terms to the consumer’s detriment.
6. Returns, withdrawal and refunds
The return procedure, statutory withdrawal period for eligible goods, exceptions for personalised goods and certain sealed hygiene goods, and refund process are described in Returns & Refunds.
7. Conformity, defects and statutory guarantees
All mandatory consumer rights relating to conformity of goods are preserved. Where Portuguese consumer law applies, the trader’s liability for lack of conformity of new movable goods is generally three years from delivery under Decree-Law no. 84/2021, subject to the conditions, presumptions and remedies provided by applicable law.
8. Customer accounts
Where customer accounts are available, the user is responsible for keeping access credentials secure and for providing accurate and up-to-date information. Suspected unauthorised activity should be reported promptly.
9. Website use
The store may not be used for unlawful, fraudulent or abusive purposes, or in a way that interferes with the security, availability or operation of the website, checkout or related services.
10. Intellectual property
Unless otherwise indicated, the Paleta Studio name, original website content, layout, photography and other original materials are protected by applicable intellectual-property rules. Third-party trademarks, including Kryolan, belong to their respective owners.
11. Third-party services
The store uses services supplied by third parties, including Shopify, payment providers, carriers and technical infrastructure providers. Their systems may have separate terms and privacy practices. Nothing in this clause removes Paleta Studio’s legal obligations to customers.
12. Personal data
Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.
13. Changes to these terms
We may update these terms when necessary to reflect legal, operational or service changes. The version applicable to a purchase is the version in force when the order is placed, unless mandatory law requires otherwise.
14. Applicable law and consumer rights
These terms are governed by Portuguese law to the extent permitted by applicable conflict-of-law rules. Consumers resident in another jurisdiction retain any mandatory protections that cannot lawfully be excluded by a choice-of-law clause.
